Privacy Policy – Mobile Apps in relation to the Badging System

Background:

This present privacy policy is reflecting the rules of accessing and managing the account of the “Mobile Work X” app for any individual using it, regardless of whether these individuals are employed by ArcelorMittal, or third parties such as contractors, or affiliates, and irrespective of where these resources are accessed from the User(s) (hereafter defined) in compliance with the General Data Protection Regulation 2016/679 (the “GDPR”) requirements (the “Privacy Policy”).

ArcelorMittal has adopted a data protection procedure which include the Binding Corporate Rules. The ArcelorMittal data protection procedure is a group-wide procedure ensuring a minimum standard of protection for Personal Data shared at global level, like the protection offered under EU rules.

This Privacy Policy provides a global and simplified legal basis for the Mobile App sharing Personal Data within the group.

This Privacy Policy explains how we collect and use personal data obtained through this Mobile App and is applicable to each ArcelorMittal entity. However, ArcelorMittal recognizes that certain laws may require stricter standards and rules than those described in this Privacy Policy. In such a case, the applicable local laws prevail. Where applicable local laws provide a lower level of requirements and rules less stringent than those established by this Privacy Policy, then the requirements of this Privacy Policy shall apply.

Please note that this present Privacy Policy must be read in conjunction with the Data Protection procedure, the Corporate Privacy Policy and the Badging Addendum for Suppliers.  Links to these documents can be found in the “References” section of this document.

1. General

ArcelorMittal has put in place on its sites/ plants a Badging System that serves a triple purpose:

  1. Grant access only to individuals including contractor’s employees that have a valid reason to be on site (e.g., to carry out work);
  2. Protect the safety of those individuals including contractor’s employee by giving them access to possibly hazardous areas only if they possess valid permits and have successfully been trained;
  3. Provide a means to validate Contractor’s compliance with the terms and conditions of the Contract and/or the Purchase Order.

“Mobile Work X” is a Mobile Application   installed by User(s) (herein after defined) linked to the Badging system for the purpose listed in above during their presence in the sites/plants of ArcelorMittal.

Before you start using the Mobile App, AM requires your consent to the collection and processing of your Personal Data which consent can be withdraw at any time. If you do not agree with the terms of this present Privacy Policy, you may not use in any manner the Mobile App. However, in case of refusal to consent to the processing of your Personal Data, the conditions of use of the Badging System will remain unchanged without negative consequences for the individual who refused to give her/his consent.

By using the Mobile App, you grant AM permission to access to personal data used for badging and location of badging.

2. Definition

"Account" means the account provided to the User by Arcelormittal to access the Mobile App. 

“Personal Data” means any information relating to an identified or identifiable natural person.

“User” means any individual that have the ability to install and effectively use the mobile App on a mobile device.

“Mobile App" means the mobile application which the User has to download on its mobile device which will serve to process the User Personal Data in relation to the Badging System.

3. Information collected by ArcelorMittal

ArcelorMittal may collect types of personal information including Personal Data from the Users of the Mobile App, and store it on your mobile device.

Arcelormittal will take reasonable cyber security precautions that ensure the confidentiality of this personal data. In this regard, ArcelorMittal’s staffs who have access to or are responsible for the processing of Personal Data are bound by a contractual or statutory obligation of confidentiality.

4. How does ArcelorMittal use your Personal Data

For the purpose of the Mobile App, ArcelorMittal and its affiliates may collect, use, maintain and may share your Personal Data provided by you, when necessary to ensure the proper functioning and operation of the Mobile App.

These purposes may include (but not limited):

  • Creating and managing your Account to use the Mobile App
  • Providing information and allowing the Users access to the Site/ Plant of ArcelorMittal;
  • Contacting the Users by phone, email, text message or push notifications maintenance and others;
  • Maintenance of the Mobile App
  • Security of the Site/Plant, identify and prevent fraud, misuse, and other unlawful activity.
  • Complying with and enforcing any applicable legal obligations with respect to our Terms of Use and this Privacy Policy.

5. User(s)’s rights in relation to the information collected

  • Right of access:  If you are concerned or have any questions about your Personal Data, you have the right to request access to the Personal Data which we hold or process about you. We will then provide you with information about the data that are being processed.
  • Right of rectification and right of erasure: As User, you have the right to request correction, erasure in your Personal Data.
  • Right to object to automatization: You have the right to request not to be subject to a decision based solely on automated processing that might affect you.
  • Right to object to data processing: You may withdraw at any time your consent to the processing of your Personal Data by Arcelormittal by permanently removing the Mobile App.

6. Data retention and deletion

In accordance with the GDPR, the personal information including Personal Data proceeded by ArcelorMittal for the purpose of the Mobile App usage can be kept and retained for as long as reasonably needed when these is a legitimate interest and in accordance with the data retention policy as applicable in the concerned business unit/segment.
